Acceptance of Terms
By purchasing, downloading, or using Rosply ("the Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Software.
These terms apply to all versions of Rosply, including updates, documentation, and any associated extensions (such as the VS Code code generation extension).
Your continued use of the Software following any update to these terms constitutes acceptance of the revised terms.
Product Description
Rosply is a desktop automation tool that uses AI vision models to perceive the screen and execute tasks using the operating system's mouse and keyboard APIs. The Software requires Python 3.11 or newer and an API key for a vision-capable AI provider (such as OpenRouter).
The Software is provided as source code. You are responsible for setting it up according to the documentation. The developer provides setup scripts to automate installation but makes no guarantee that these scripts will work in all system configurations.
The Software includes the following components: the main automation agent, a voice control module (requires a microphone), a VS Code code generation extension, and a Claude Code MCP integration.
License
Upon purchase, you are granted a non-exclusive, non-transferable, personal license to use the Software for personal and commercial purposes on machines you own or control.
This license permits you to modify the source code for your own use. You may not resell, sublicense, or distribute the Software or derivative works to third parties without explicit written permission from the developer.
One purchase covers a single user. You may install the Software on multiple machines that you personally use. You may not share your copy with other users.
The license is perpetual and does not expire. You may use the version of the Software you purchased indefinitely, even if you no longer receive updates.
Restrictions
You agree not to use the Software to:
- Automate actions on systems, accounts, or services you do not have explicit permission to access
- Bypass security controls, CAPTCHAs, rate limits, or access restrictions
- Violate the terms of service of any third-party application, website, or API
- Scrape, harvest, or collect data in violation of a website's terms of service or applicable law
- Perform any activity that is unlawful, harmful, fraudulent, or deceptive
- Harass, stalk, or harm other individuals
- Resell, relicense, or redistribute the Software in any form
- Use the Software in any automated testing or load-generation capacity against third-party services without authorization
Platform Support
Rosply is designed and primarily tested on Windows 10 and Windows 11. It is the recommended and best-supported platform.
Experimental support for macOS and Linux is available. On these platforms, core functionality (mouse control, keyboard input, screenshot capture) is implemented, but the following features are not available or have not been fully tested:
- The VS Code code generation extension (Windows-only installer)
- The voice wake-word module (relies on Windows audio APIs)
- The claude-setup.bat MCP registration script
- Full compatibility with the setup.bat installation script
macOS support has not been tested in a production environment. The developer makes no warranty regarding stability or feature completeness on macOS or Linux. Issues specific to non-Windows platforms are handled on a best-effort basis.
Refund Policy
Because the Software is delivered as source code and is immediately accessible upon purchase, all sales are generally final.
Refunds may be considered within 7 days of purchase if the Software does not function on a supported platform (Windows 10/11 with Python 3.11+) and the issue cannot be resolved through support. To request a refund, contact support@rosply.com with your order details and a description of the issue.
Refunds will not be issued for issues related to third-party services (OpenRouter, API providers), system configurations not meeting the minimum requirements, or user error.
Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The Software controls your mouse and keyboard to execute tasks. You are solely responsible for reviewing the tasks you give to the agent and monitoring its behavior. The developer is not responsible for any unintended actions, data loss, or consequences resulting from the Software's operation.
AI models accessed via OpenRouter or other providers may produce unexpected, incorrect, or harmful results. The Software includes an emergency stop (Ctrl+H) and a per-run action limit, but these safeguards do not guarantee that all tasks will be executed correctly or safely.
The developer does not guarantee that the Software will be error-free, uninterrupted, or compatible with all future versions of third-party applications or operating systems.
Limitation of Liability
IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO DATA LOSS, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS INFORMATION) ARISING FROM THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
The total cumulative liability of the developer, for any cause whatsoever, shall not exceed the amount actually paid by you for the Software.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, the above limitations apply to the fullest extent permitted by applicable law.
Intellectual Property
The Software, including its source code, documentation, and all associated materials, is the intellectual property of the developer and is protected by copyright law.
Purchasing the Software grants you a license to use it as described in these Terms. It does not transfer ownership of the intellectual property to you.
If you submit bug reports, feature suggestions, or other feedback to the developer, you grant the developer a non-exclusive, royalty-free license to use that feedback to improve the Software without any obligation to you.
Third-Party Services
The Software integrates with or relies on the following third-party services. Your use of those services is governed by their own terms, not these Terms of Service.
The developer is not responsible for the availability, reliability, or data practices of any third-party service. Outages or changes in third-party APIs may affect the Software's functionality.
AI and Automation Usage
Rosply sends screenshots of your primary monitor and task descriptions to the AI model you configure. By using the Software you explicitly consent to this data being transmitted to your chosen AI provider on each step of a task.
You are responsible for ensuring that any data visible on your screen during automated sessions is handled in compliance with applicable privacy laws, your employer's policies, and your obligations to third parties. Do not run Rosply on screens displaying confidential information unless you are certain about your AI provider's data handling practices.
The Software is designed for single-user use on a single primary monitor. Automated access to third-party services using Rosply must comply with those services' terms of service and all applicable laws.
The developer is not responsible for how third-party services use, store, or process data transmitted by the Software.
Updates and Support
The purchase price includes all future updates to the Software. Updates are distributed at the developer's discretion and are not guaranteed on any specific timeline or schedule.
Support is provided on a best-effort basis via email at support@rosply.com. There is no guaranteed response time or resolution commitment. The developer reserves the right to discontinue active development at any time; the license to use the purchased version remains valid indefinitely.
The developer may change the Software's features, remove integrations with third-party services, or alter system requirements in future updates without prior notice.
Termination
Your license to use the Software is effective until terminated. It terminates automatically and without notice if you violate any provision of these Terms of Service.
Upon termination, you must cease all use of the Software and destroy all copies in your possession, including any modifications you have made to the source code.
The developer reserves the right to refuse service or revoke a license in cases of confirmed abuse, fraud, or violation of these terms, without obligation to issue a refund.
Governing Law
These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these terms or the Software shall be resolved through good-faith negotiation between the parties.
If you are a consumer in a jurisdiction that affords you mandatory legal protections, those protections remain unaffected by these terms.
